Service Description
ClientHunter is an email automation platform that allows users to send cold outreach emails through their own Gmail accounts or Resend email service. The service operates by connecting to your email accounts and sending emails on your behalf based on your project configurations.
CRITICAL: Email Marketing Compliance - Your Legal Responsibilities
YOU ARE SOLELY AND FULLY RESPONSIBLE FOR COMPLIANCE WITH ALL EMAIL MARKETING LAWS. ClientHunter is not responsible for any legal violations, fines, penalties, or consequences resulting from your use of this service.
By using ClientHunter, you acknowledge and agree that you are the sender of all emails sent through this platform using your connected accounts. You must comply with:
- CAN-SPAM Act: Requires accurate header information, non-deceptive subject lines, clear identification as advertisement, physical postal address, unsubscribe mechanism that works for 30 days, and honoring opt-outs within 10 business days. Violations can result in fines up to $51,744 per email.
- GDPR: Requires explicit consent before sending marketing emails to EU residents, clear purpose for data collection, right to access/rectify/delete data, unsubscribe mechanism, data processing records, and privacy policy disclosure. Violations can result in fines up to €20 million or 4% of global annual revenue.
- CASL: Requires express or implied consent, sender identification and contact information, unsubscribe mechanism that works for 60 days, and immediate opt-out honoring. Violations can result in penalties up to $10 million CAD per violation.
- Other applicable laws: You must comply with all applicable email marketing, privacy, and anti-spam laws in the jurisdictions where your recipients are located.
Your Mandatory Obligations:
- Obtain proper consent before sending marketing emails
- Include functioning unsubscribe links in ALL marketing emails
- Include your physical postal address in marketing emails
- Use accurate sender information and non-deceptive subject lines
- Honor all unsubscribe requests immediately and maintain opt-out lists
- Keep records of consent and opt-outs
- Respect recipients' privacy rights and data protection requirements
- Understand the difference between transactional and commercial emails
ClientHunter provides email automation tools but does NOT provide legal advice. We are NOT responsible for your compliance. Violations of email marketing laws can result in severe penalties including substantial fines, legal action, criminal charges, and reputational damage. You use this service entirely at your own risk and accept full legal responsibility for all emails sent.
User Responsibilities
By using ClientHunter, you agree to:
- Comply with all applicable email marketing laws including CAN-SPAM, GDPR, CASL, and others
- Obtain proper consent before sending emails to recipients
- Include unsubscribe mechanisms and honor opt-out requests immediately
- Use accurate sender information and non-deceptive content in all emails
- Maintain the security of your account credentials and connected services
- Not use the service for spam, harassment, fraud, or any illegal activities
- Accept full legal responsibility for all emails sent through your connected accounts
- Indemnify and hold harmless ClientHunter from any claims, damages, or legal action resulting from your use of the service
Important: Email Account Disclaimer
We are not responsible for any bans, suspensions, account terminations, or loss of access to Gmail, Resend, or any other connected services that may occur as a result of using ClientHunter.
Using automated email tools may violate the Terms of Service of email providers. Gmail, Resend, and other providers reserve the right to suspend or terminate accounts that violate their policies, send spam, or generate complaints. By using ClientHunter, you acknowledge and accept that:
- You use ClientHunter at your own risk
- We are not liable for any consequences resulting from email provider account actions
- You are solely responsible for ensuring your use complies with email provider policies
- Any bans, suspensions, or account losses are your sole responsibility
- Emails are sent through YOUR accounts using YOUR credentials - you are the sender
Payment Terms
Subscription fees are billed monthly in advance. By subscribing, you authorize us to charge your payment method for the subscription fee. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods.
Limitation of Liability
To the maximum extent permitted by law, ReddBot and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the service.
Service Availability
We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice. We may also update these Terms of Service from time to time, and continued use of the service constitutes acceptance of any changes.
Limitation of Service
We reserve the right to refuse service, suspend, or terminate accounts that:
- Violate these Terms of Service
- Generate excessive spam complaints or bounce rates
- Engage in illegal activities or send emails in violation of applicable laws
- Abuse the service or use it in ways that harm our reputation or operations
- Fail to comply with email marketing regulations
